03 / IN FOCUS
Regulatory Investigation Process
01 — Identify
Identify the entity, platform, website, service or activity requiring review.
02 — Verify
Check publicly available information against relevant official regulatory sources and available regulatory registers.
03 — Analyse
Assess the entity's stated activities, jurisdiction, regulatory claims and available evidence to identify potential regulatory concerns.
04 — Document
Prepare a structured record of relevant findings, sources, regulatory information and potential client-impact considerations.
05 — Transition
Where an existing crypto-asset service provider is no longer authorised or is unable to continue providing the relevant services, an authorised CASP may support the orderly migration of affected clients.
Subject to applicable legal, regulatory and operational requirements, this may include client onboarding, due-diligence procedures, account establishment, transfer arrangements and the receipt or transfer of crypto-assets or client relationships.
06 — Escalate
Where appropriate, relevant information may be directed to the competent authority or applicable official reporting channel.
04 / PLEASE NOTE
Important
Regulatory authorisation, supervision and enforcement remain the responsibility of the relevant competent authorities.
Where an authorised CASP provides services to clients transitioning from another provider, all onboarding, due-diligence, asset-transfer and client-protection requirements must be satisfied in accordance with applicable law and the CASP's regulatory obligations.
Our objective is to support a transparent and orderly transition from potentially unauthorised or discontinued services towards appropriately authorised crypto-asset services.
