CASP AML

The Transition Period Has Ended

The Transition Period Has Ended

The MiCA transition was designed to give certain existing crypto-asset businesses time to move from national frameworks into the new EU framework.

Article 143(3) allowed qualifying CASPs that were providing services in accordance with applicable law before 30 December 2024 to continue under transitional arrangements until 1 July 2026 at the latest, or until authorisation was granted or refused, whichever occurred sooner. Member States could shorten or remove the transition.

What Changed on 1 July 2026?

The maximum EU transition date has now passed.

The CSSF has advised consumers that providers are no longer permitted to offer relevant services without CASP authorisation from 1 July 2026, subject to the applicable legal framework.

What Should Users Check?

1. Legal entity

What is the company's exact legal name?

2. Jurisdiction

Where is it established?

3. Regulator

Which competent authority is responsible?

4. Authorisation

Does the provider appear in the relevant official register?

5. Services

Are the services offered consistent with the regulatory status?

6. Public claims

Does the company accurately describe its regulatory position?

Third-Country Providers

Third-country firms that actively offer crypto-asset services to EU clients may require EU authorisation. The MiCA framework provides a narrow exception for services initiated exclusively by the client, subject to the conditions of Article 61; this should not be treated as a general marketing route into the EU.
